Understanding Kenya’s Artificial Intelligence Bill, 2026

Kenya’s Artificial Intelligence Bill, 2026 introduces a formal legal framework governing the development, deployment, and use of AI systems.

1. What Counts as “Artificial Intelligence”?

The bill defines artificial intelligence as a machine-based system or collection of technologies that leverage machine learning, data processing, algorithmic systems or other methods to operate with varying levels of autonomy and adaptiveness, inferring outputs such as predictions, content recommendations, or decisions from inputs, and includes systems or technologies that perform tasks typically requiring human intelligence, such as automated decision-making, language processing, and computer vision.

2. Creation Of A New Regulatory Authority

• Enforcing AI compliance.
• Conducting audits.
• Risk assessments of AI systems.
• Managing regulatory sandboxes.
• Issuing guidelines and standards. 

3. Classification Of Artificial Intelligence Systems

The bill, like the EU AI Act, adopts a risk-tied approach. The categories include:

• Unacceptable Risk(banned) 
• High Risk
• Limited Risk
• Minimal Risk 

High-risk systems would require risk assessments to be conducted, including human rights impact assessments. They should also ensure transparency, traceability and explainability. The data used in the training would need to be stored, including the input/output logs. Compliance with the Data Protection Act is also necessary.

4. Ethical AI Requirements

Those implementing the AI systems(developers) must ensure that the systems:

• Avoid discrimination
• Protect privacy.
• Allow for human intervention.
• Prevent misinformation.

5. Human-Centric AI

The bill envisions a world where AI systems enhance, rather than replace, humans. It also anticipates human-in-the-loop, especially in instances where critical decisions are to be made.

In cases where the AI systems would affect workforces, companies/institutions would be required to conduct workforce impact assessments and provide reskilling programs.

6. Offenses & Penalties

You are considered to have commited an offence if your AI system:

• Makes use of prohibited AI systems/models classified as having an unacceptable risk under section 25(except for the circumstances provided by regulations).
• Skips risk assessments or implementing mitigating measures as described under sections 26.
• Causes prejudice to public benefit or rights.
• Fails to comply with disclosure or transparency under section 28 of the bill.
• Participates in a regulatory sandbox under section 29 without adhering to the prescribed conditions.
• Fails to conduct a workforce impact assessment under section 32.
• Obstructs the Office of the Artificial Intelligence Commissioner in the performance of its function, including providing false information or failing to submit required reports or generating, deploying, deploys or distributes artificial intelligence-generated content, including synthetic media using a persons image, voice, or likeness without their explicit consent, where such content causes or likely to cause harm, misinformation, or infringement of privacy.

Companies/institutions need to take stock of what they’ve already built. This involves auditing every AI feature currently in your products, classifying them by risk level, and introducing compliance layers where necessary.

Beyond the audit, there are capabilities you’ll need to develop internally if you don’t have them yet. AI governance frameworks, data lineage tracking, explainability tooling, and consent management aren’t optional add-ons anymore. They’re becoming the baseline for any firm working seriously with AI. The bigger shift, though, is cultural.
